01. About Our Service

Discover Africa Safaris is a safari marketplace. We connect travelers with independent, verified tour operators who provide safari experiences across Africa. We are not a tour operator ourselves. When you submit an inquiry or booking request through our platform, we pass that inquiry to the relevant operator who is responsible for delivering the services.

This distinction matters: the contract for your safari is between you and the tour operator, not us. We facilitate the introduction, but we do not control the operator's pricing, itinerary, safety practices, or delivery.

02. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our services. By using this site, you confirm that you meet these requirements and that all information you provide is accurate, current, and complete.

03. Bookings & Payments

When you submit a booking inquiry, you are requesting a quote from the tour operator. A contract only forms when:

• The tour operator confirms your booking in writing, and
• You pay the deposit required by the operator.

Payment terms, deposit amounts, cancellation policies, and refund rights are set by each operator. You must read and agree to the operator's terms before booking. We do not process payments — all payments are made directly to the tour operator using their own payment methods.

04. Cancellations & Refunds

Cancellation and refund policies vary by operator and by season. Most operators require cancellation at least 60–90 days before departure to receive a partial refund. Last-minute cancellations are typically non-refundable.

We recommend comprehensive travel insurance that covers trip cancellation, medical emergencies, evacuation, and lost baggage. We are not liable for any refunds, penalties, or losses arising from cancellation policies set by tour operators.

05. Accuracy of Information

We work hard to keep package details, pricing, and itineraries accurate. However, prices and availability change frequently and are set by the tour operators. Final prices are confirmed only when the operator issues you a formal quote.

We are not responsible for errors, omissions, or outdated information on our site, including typos, incorrect photos, or mismatched pricing. If you spot a mistake, please contact us so we can fix it.

06. Travel Risks & Assumption of Risk

African safaris involve inherent risks, including but not limited to: encounters with wild animals, rough terrain, remote locations, tropical diseases, political instability, and unpredictable weather. By booking a safari, you acknowledge these risks and accept them voluntarily.

You are responsible for obtaining the correct visas, vaccinations, travel insurance, and travel documents. We are not liable for denied entry, missed flights, or losses resulting from improper documentation.

07. Intellectual Property

All content on this site — including text, logos, graphics, images, layouts, and code — is owned by Discover Africa Safaris LLC or used with permission from the respective copyright holders. You may not copy, reproduce, distribute, or republish any content without our written consent.

Package photos and descriptions may belong to the respective tour operators and are used here under licence or fair use. If you believe content on our site infringes your copyright, please contact us immediately.

08. Acceptable Use

You agree not to:

• Use the site for any illegal purpose
• Submit false, misleading, or fraudulent inquiries
• Attempt to scrape, copy, or reverse-engineer the site
• Interfere with the site's security or operation
• Impersonate another person or business
• Post or transmit viruses, malware, or harmful code

We reserve the right to block access, cancel inquiries, and pursue legal action against users who violate these rules.

09. Third-Party Links

Our site may contain links to third-party websites, including tour operators, review platforms, and payment processors. We do not control these sites and are not responsible for their content, privacy practices, or security. Visiting them is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Discover Africa Safaris LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of, or inability to use, this website
• Any booking made with a tour operator through our platform
• Any injury, loss, damage, or delay during your safari
• Any third-party content, products, or services referenced on our site

Our total liability to you for any claim arising out of these Terms shall not exceed the amount of any commission we received for the specific booking related to your claim, or USD $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Discover Africa Safaris LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the site.

12. Modifications to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will always reflect the most recent version. Continued use of the site after changes means you accept the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Republic of Tanzania, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the site shall be resolved exclusively in the courts of Dar es Salaam, Tanzania.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
